Donation & Refund Policy for Diamond Voices

Diamond Voices is a cultural, educational, artistic, and community-oriented initiative dedicated to fostering
intercultural dialogue, music, podcasts, creative collaboration, and social engagement.


This Donation & Refund Policy governs all donations made through www.diamondvoices.org and is drafted in accordance with applicable Belgian and European legislation, including the Belgian Code of Economic Law (Wetboek Economisch Recht / Code de droit économique), the Belgian Civil Code, and applicable European consumer protection and data protection laws.

By making a donation, you acknowledge that you have read, understood, and accepted this Policy.

1. Nature of Donations

All donations made to Diamond Voices constitute voluntary and unconditional contributions intended to support the mission, activities, projects, operations, and objectives of Diamond Voices.

Donations may be used to support:

  • Community-building initiatives

  • Musical productions

  • Podcasts and media projects

  • Educational programs

  • Cultural activities

  • Events and workshops

  • Website and technology infrastructure

  • Administrative and operational expenses

  • Future Diamond Voices initiatives

Donations are not intended as payments for goods, services, memberships, subscriptions, financial products, or investment opportunities.

2. No Investment or Ownership Rights

A donation to Diamond Voices is not an investment and does not constitute a financial instrument under Belgian or European financial legislation.

A donation does not:

  • Create ownership rights.

  • Create shareholder rights.

  • Create partnership rights.

  • Create membership rights.

  • Create voting rights.

  • Create profit-sharing rights.

  • Confer any entitlement to revenues, royalties, dividends, or financial returns.

  • Grant any interest in the intellectual property, assets, projects, or operations of Diamond Voices.

Donors acknowledge that donations are made voluntarily to support the objectives of Diamond Voices and not in exchange for financial gain or future benefits.

3. No Guarantee of Outcomes

Diamond Voices does not guarantee:

  • The completion of any specific project.

  • The success of any initiative.

  • Public recognition.

  • Media exposure.

  • Participation in specific activities.

  • Commercial success.

  • Social, cultural, or economic outcomes.

Donations support the broader mission of Diamond Voices and shall not create any obligation to achieve a particular result.

4. Allocation of Funds

Diamond Voices retains full discretion regarding the allocation and use of donated funds.

 

While donations may be solicited for specific campaigns or projects, Diamond Voices reserves the right to allocate funds where reasonably necessary to advance its mission and ensure the sustainability of its activities.

 

If a specific project is cancelled, modified, postponed, or becomes impracticable, donated funds may be redirected to similar projects or activities that support the objectives of Diamond Voices.

5. Finality of Donations

All donations made to Diamond Voices are deemed final and non-refundable.

By making a donation, the donor expressly acknowledges that:

  • The donation constitutes a voluntary gift.

  • No contractual right to a refund is created.

  • No statutory right of withdrawal applies solely because the donor changes their mind.

  • The donation is not made in exchange for goods or services.


Under Belgian law, voluntary donations are generally not subject to the withdrawal rights applicable to consumer sales contracts for goods or services.

6. Exceptional Refund Requests

Although donations are generally final and non-refundable, Diamond Voices may, at its sole and absolute discretion, review refund requests in exceptional circumstances.

Such circumstances may include:

  • Unauthorized transactions.

  • Fraudulent use of a payment method.

  • Duplicate payments.

  • Technical processing errors.

  • Manifest payment mistakes.

 

The submission of a refund request does not create an obligation on the part of Diamond Voices to grant a refund.

Each request will be assessed individually based on the facts and applicable legal requirements.

7. Situations Where Refunds Will Generally Not Be Granted

Refunds will generally not be provided where:

  • The donor changes their mind.

  • The donor disagrees with activities, projects, statements, or future initiatives of Diamond Voices.

  • The donor no longer wishes to support Diamond Voices.

  • The donated funds have already been allocated or spent.

  • The donation was made knowingly and voluntarily.

  • The donor expected benefits that were not expressly promised.

8. Refund Request Procedure

A donor wishing to request an exceptional refund must submit a written request containing:

  • Full name

  • Email address

  • Donation amount

  • Donation date

  • Transaction reference number

  • Detailed reason for the request

 

Requests must be submitted within thirty (30) calendar days of the donation date.

Diamond Voices reserves the right to request supporting documentation before making a decision.

9. Approved Refunds

Where Diamond Voices approves a refund request:

  • The refund will generally be issued using the original payment method.

  • Refund processing times may vary depending on the payment provider or financial institution.

  • Transaction fees, banking costs, and processing fees that cannot be recovered may be deducted where legally permitted.

  • Diamond Voices shall not be responsible for delays caused by payment service providers, banks, or third parties.

10. Fraud Prevention and Legal Compliance

Diamond Voices reserves the right to refuse, suspend, investigate, or reverse donations where there are reasonable grounds to suspect:

  • Fraud.

  • Identity theft.

  • Unauthorized payment activity.

  • Money laundering.

  • Terrorist financing.

  • Sanctions violations.

  • Other unlawful activities.

Diamond Voices may cooperate with competent authorities, financial institutions, payment service providers, and law enforcement agencies where required by law.

11. Tax Treatment

Donors are solely responsible for determining the tax consequences of any donation.

 

Unless explicitly stated otherwise, Diamond Voices does not guarantee that donations qualify for tax deductions or other fiscal benefits under Belgian or foreign legislation.

 

Donors should consult their own legal, financial, or tax advisers.

12. Data Protection

Personal data collected during the donation process shall be processed in accordance with:

  • The General Data Protection Regulation (GDPR) (EU) 2016/679.

  • The Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.

  • The Diamond Voices Privacy Policy.


Information may be processed for administrative, accounting, legal, security, and donor relationship purposes.

13. Consumer Rights

Nothing in this Policy shall exclude, restrict, or limit any mandatory rights granted under Belgian or European law.

 

If any provision of this Policy is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

14. Governing Law and Jurisdiction

This Donation & Refund Policy shall be governed exclusively by the laws of Belgium.

 

Any dispute arising out of or relating to donations made through Diamond Voices shall be subject to the jurisdiction of the competent courts of Antwerp, Belgium, unless mandatory provisions of Belgian or European law provide otherwise.

15. Legal Notice

Diamond Voices is a community-oriented cultural initiative.

Donations constitute voluntary contributions and are not:

  • Investments.

  • Securities.

  • Crowdfunding investments.

  • Savings products.

  • Financial instruments.

  • Equity participations.

  • Profit-sharing arrangements.

  • Ownership interests.


No statement on this website shall be interpreted as a solicitation for investment or as an offer of financial products within the meaning of applicable Belgian or European financial services legislation.

Refund requests are reviewed on a case-by-case basis in accordance with this Policy and applicable Belgian law.
